Said policy can be summed up as "we'll ban whatever we feel like banning, and your only warning will be trying to log in and finding your journal is gone."

If anybody else has bailed to insanejournal, I'm bladespark over there too.

Of course, insanejournal's TOS appears to be the same type of thing. Can discontinue at any time without notice etc etc. I think it would be rare these days for any site to not have their TOS state such things. If they act on it, though, that's the kicker...

All sites have a "we can do whatever if we really want to" in their terms.

HOWEVER, most sites have a clear, listed policy of what they will actually ban for. LJ does not. There is NO clear, straightforward, and understandable guideline for what is acceptable and what is not. InsaneJournal's TOS allows them legally to ban you for whatever, and that is fine, but they do not actually exercise that right, preferring to abide by their policies rather than by their legalese.

LJ is legally able to do whatever they want. They are just choosing to not state a firm definition of their policies, but rather to just arbitrarily ban anything that gets reported that they feel they might not like today, but ask again tomorrow.
